THIS WEBSITE AND ITS CONTENT (the “Website”) IS THE PROPERTY OF IPSO FACTO REAL ESTATE INVESTMENT AND ITS AFFILIATES (COLLECTIVELY « IPSO FACTO») AND CANNOT BE COPIED, REPRODUCED, REPUBLISHED, DOWNLOADED, TRANSMITTED, DISTRIBUTED OR USED WITHOUT THE PRIOR WRITTEN CONSENT OF IPSO FACTO.

BY ACCESSING AND USING THIS WEBSITE, THE USER AGREES TO BE BOUND BY THE PROVISIONS OF THE PRESENT LEGAL NOTICE AND USAGE AGREEMENT AND ACKNOWLEDGES AND AGREES TO COMPLY WITH ALL OF THE FOLLOWING TERMS OF USE.

PRIVACY AND ACCESS TO INFORMATION

When it comes to the protection of personal information, Ipso Facto is subject to the provisions of the ACT RESPECTING THE PROTECTION OF PERSONAL INFORMATION IN THE PRIVATE SECTOR (CQLR c.P-39.1) (the “Act“), which were amended in September 2022.

Information collected and its use

Ipso Facto collects miscellaneous personal information through its Website, using log files, cookies and web beacons, including Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time, referring/exit pages and possibly the number of clicks, visitor preferences and which pages of the Website the visitor accessed or visited. These are not linked to any personally identifiable information. The content gathered is not linked to any personally identifiable information and is used to optimize the user experience by customizing the content of the site based on the visitor’s type of browser or other information.

In addition, in the course of its business, Ipso Facto gathers a variety of personal information, which is necessary for the execution of its investments and its operations. Such information includes surnames, given names, postal codes, email addresses, telephone numbers, job titles, financial and banking information, other identification and verification information such as copies of passports, driver’s licences and information obtained in the course of our business.

Any information collected by Ipso Facto, where applicable, remains strictly confidential and will not be communicated, sold, rented or lent out, without having obtained the consent of the persons concerned, except in cases where the Law allows it.

Ipso Facto may use third-party suppliers to manage certain aspects of its activities, including its technology services. These mandated third parties may have access to personal information when it is necessary for the performance of their contract. They are bound by the same confidentiality obligations and must protect personal information held in accordance with the Act.

Consent

Ipso Facto ensures that its business partners are aware of the purposes for which personal information is collected, used and disclosed. By providing personal information to Ipso Facto, you authorize us to collect, use, disclose and retain such personal information as authorized or required by law.

At any time, you may refuse or withdraw your consent by contacting the person responsible for privacy and access to information. We reserve the right to refuse certain requests in accordance with applicable laws.

Access to Information Request

Any individual who requests it, has the right to be informed of the existence of personal information concerning them, of the use made of it and of the fact that this personal information has been communicated to third parties. The individual who makes the request also has the right to consult the information that Ipso Facto holds about them, subject to the exceptions provided for by applicable legislation. Upon request, the individual may obtain a list of organizations or third parties to whom their personal information has been or may have been communicated to. Said individual may also contest the accuracy and completeness of the personal information concerning them and that Ipso Facto make the appropriate corrections as soon as possible when the individual has demonstrated that this information is inaccurate or incomplete.

To exercise their rights, the individual to whom the personal information pertains must send a written request in this regard to sbeaudoin@ipsofactoimmobilier.com or by mail to the attention of Mr. Simon Beaudoin, Associate director, Investments of Ipso Facto Real Estate Investment. The protocol to follow will then be provided. Any request will require verification of identity and eligibility to assert these rights.

Governing law

This Website is governed by the laws in force in the Province of Québec, Canada, and is subject to the application of these laws, without giving effect to any conflict-of-law principles.
